Terms of Service – Whaazs

These Terms of Service govern access to and use of the Whaazs platform in OHADA member countries and, more broadly, across Africa. By using the platform, you agree to be bound by these terms without reservation.
1. Definitions
- Platform: the Whaazs service accessible via web and mobile
- User: any individual accessing the platform
- Creator: a user offering monetized content or services
- Content: any material published (text, images, video, audio, etc.)
- Mobile Money: mobile payment services (MTN MoMo, Orange Money, etc.)
2. Access and Eligibility
- You must be at least 18 years old to use Whaazs
- You are responsible for maintaining the security of your account
- All information provided must be accurate and up to date
- Identity verification (KYC) may be required for certain features
3. Acceptable Use
You agree not to:
- Publish illegal, fraudulent, or misleading content
- Infringe on the rights of others
- Share violent, hateful, or unlawful content under local laws
- Use the platform for money laundering or illegal activities
- Attempt to bypass security or payment systems
4. User Content
- You retain ownership of your content
- You grant Whaazs a non-exclusive license to use, host, and distribute your content on the platform
- You are solely responsible for the content you publish
Whaazs reserves the right to remove any content that violates these terms or applicable local laws.
5. Monetization and Payments
Creators may earn revenue through:
- Subscriptions
- Pay-per-view content
- Tips and donations
- Live streaming and video calls
- Sale of products or services
Accepted payment methods include:
- Mobile Money (MTN MoMo, Orange Money, etc.)
- Bank cards
- Other locally available solutions
Whaazs may apply transaction fees or commissions.
6. Wallet, Withdrawals, and Mobile Money
- Earnings are credited to a digital wallet
- Withdrawals may be made via Mobile Money or other available methods
- Withdrawals are subject to:
- Minimum thresholds
- Identity verification (KYC)
- Processing delays
Whaazs may suspend withdrawals in case of suspected fraud or illegal activity.
7. Regulatory Compliance (OHADA & Anti-Fraud)
Users agree to comply with:
- Applicable local laws and regulations
- OHADA uniform acts governing commercial activities
- Anti-money laundering (AML) and counter-terrorism financing regulations
Whaazs reserves the right to:
- Verify user identities
- Block or report suspicious activities to relevant authorities
8. Marketplace and Services
- Creators may sell digital products or offer services
- Whaazs acts as a technical intermediary
- Users are responsible for their transactions
In case of disputes:
- Parties must first attempt amicable resolution
- Whaazs may act as a mediator without obligation of outcome
9. Suspension and Termination
Whaazs may suspend or terminate an account in case of:
- Violation of these terms
- Fraudulent or suspicious activity
- Non-compliance with applicable laws
Users may delete their account at any time.
10. Taxation
- Creators are responsible for complying with their local tax obligations
- Whaazs is not responsible for tax reporting or payments
11. Intellectual Property
- All platform elements remain the property of Whaazs
- Any unauthorized reproduction is prohibited
12. Limitation of Liability
Whaazs shall not be held liable for:
- Indirect financial losses
- Disputes between users
- Service interruptions related to local networks or Mobile Money providers
13. Data Protection
Personal data is processed in accordance with the Whaazs Privacy Policy.
14. Changes
Whaazs may update these Terms at any time. Users will be notified of significant changes.
15. Governing Law and Jurisdiction
These Terms are governed by:
- The laws of the country where Whaazs operates
- OHADA uniform acts
In case of dispute, jurisdiction lies with the competent courts of the relevant country.
